Standard on Qualifications of Realty Management Enterprises

I. Legal Basis 

Regulation on Realty Management (Decree of the State Council No. 504) and The Measures for the Administration on Qualifications of Realty Management Enterprises(Decree of the State Council No. 164) from MOC (Ministry of Construction) stipulate that: “The realty management enterprises shall be with the corresponding qualification” “The real estate administrative departments of local people's governments at or above the county level shall be in charge of management of qualification of realty management enterprises in their respective areas.

II.  Application Conditions

The realty management enterprises that apply for Qualifications of Realty Management Enterprises shall conform to the following conditions, besides they shall meet the establishing conditions of the relevant laws, rules and regulations  

1. The first grade qualifications:

 (1) The registered capital shall be more than RMB 5 million Yuan;

 (2) There are no less than 30 professionals of realty management and full-time management and technical personnel in such relevant specialties as the engineering, management, or economy. Among them, there shall be no less than 20 personnel who have the intermediate title of a technical post or above, and the business managers in engineer or finance shall have the intermediate title of a technical post or above accordingly 

 (3) The realty management professionals shall obtain the certificate of vocational qualifications in accordance with the relevant provisions of the state;

 (4) Managing more than two kinds of realty, and the building areas of each kind of the realty shall account for no less than 100% of the total percentages of each of the following calculation basis respectively: 

 1) 2 million square meters for multi-floor houses;

 2) 1 million square meters for tall building houses;

 3) 150 thousand square meters for detached houses or villas; and

 4) 500 thousand square meters for office buildings, industrial workshops and other realties. And 

        (5) Establishing and implementing strictly such enterprise management system and standards as the service quality and service charge, setting up enterprise credit archive systems, and having outstanding management achievements. 

2. The second grade qualifications:

 (1) The registered capital shall be more than RMB 3 million Yuan; 

 (2) There are no less than 20 professionals of realty management and full-time management and technical personnel in such relevant specialties as the engineering, management, or economy. Among them, there shall be no less than 10 personnel who have the intermediate title of a technical post or above, and the business managers in engineer or finance shall have the intermediate title of a technical post or above accordingly;

 (3) The realty management professionals shall obtain the certificate of vocational qualifications in accordance with the relevant provisions of the state;

 (4) Managing more than two kinds of realty, and the building areas of each kind of the realty shall account for no less than 100% of the total percentages of each of the following calculation basis respectively:

1) 1 million square meters for multi-floor houses;

2) 500 thousand square meters for tall building houses;

3) 80 thousand square meters for detached houses or villas; and

4) 200 thousand square meters for office buildings, industrial workshops and other realty. And

5) Establishing and implementing strictly such enterprise management systems and standards as the service quality and service charges, setting up enterprise credit archive systems, and having outstanding management achievements.

3. The third grade qualifications:

        (1) The registered capital shall be more than RMB 500 thousand ;

(2) There shall be no less than 10 professionals of realty management and full-time management and technical personnel in such relevant specialties as the engineering, management, or economy. Among them, there shall be no less than 5 personnel who have the intermediate title of a technical post or above, and the business managers in engineer or finance shall have the intermediate title of a technical post or above accordingly;

(3) The realty management professionals shall obtain the certificate of vocational qualifications in accordance with the relevant provisions of the state;

(2) There are no less than 10 professionals of realty management and full-time management and technical personnel in such relevant specialties as the engineering, management, or economy. Among them, there shall be no less than 5 personnel who have the intermediate title of a technical post or above, and the business managers in engineer or finance shall have the intermediate title of a technical post or above accordingly; 

       (4) Having entrusted realty management projects; and 

(5) Establishing and implementing strictly such enterprise management systems and standards as the service quality and service charges,

Realty Management Enterprises with first grade qualification can undertake all kinds of realty management project 

Realty Management Enterprises with second grade qualification can undertake realty management business on residential projects with 300 thousand square meters or below and non-residential projects with 80 thousand square meters or below.

 Realty Management Enterprises with third grade qualification can undertake realty management business on residential projects with 300 thousand square meters or blow and non-residential projects with 50 thousand square meters or below.

       1. Application Form for Qualifications of Realty Management Enterprises

       2. Qualification Certificate of Realty Management Enterprises

3. Business License ( copy of the original and the duplicate)

 4. Commission Contract Realty Management(the copy)

 5. Identification of Enterprise Legal Representative(the copy)

 6. Certificate of enterprise locations(copy of agreements and property certificate)

 7. Certificate of vocational qualifications and Labour Contract of professionals of realty management(the copy)(declaration)

 8. Professional Title Certificate(s) and Labour Contract(s) of engineers and financial principal(s)(the copy)(declaration)

 9. Materials on Realty Management Achievements(the copy)

 10. Financial Statement of The Prior Year

 11. Regulation Management System

 12, Statement on Enterprise Credit Archives

 IV.  Procedures

 1. Introduced by realty management departments with local county level or above.

 2. Initial audit by municipal, provincial realty management authority

 3. The second qualification certificate(s) shall be issued by provincial department of construction; the first qualification certificate(s) shall be reported as review of second examination and approval procedures by provincial department of construction to MOC and shall be approved and issued by MOC .

 V. Time limit for Transaction

 Dealing within 20 workdays(except festivals and holidays) as of the date of the day receiving the application.
